Terms and Conditions as at May 2009
It is the responsibility of all Artisans to read through and agree to all terms and conditions outlined in this document prior to applying for a position at the Stella Maritz Pty Ltd, Shellharbour Artisan Fair. All applications received will be deemed to be in acceptance with ALL Terms and Conditions.
The Shellharbour Village Artisan Fair will be held weekly on Saturday and Sunday and prides itself in being a community driven all weather fair.
Our aim is to showcase and promote local Artisans talents and to enhance “THE STAR OF THE ILLAWARRA” that is Shellharbour Village.
The Shellharbour Village Artisan Fair is an opportunity to express and display your talents for people of all ages to enjoy.
Shellharbour Village Artisan Fair is run by the local management of Stella Maritz Pty Ltd.
Our “Village Fair” Policies and Procedures are governed by Stella Maritz Pty Ltd and can be requested at any time by contacting eh Shellharbour Village Artisan Fair manager at any time
GENERAL:
- The Artisan Fair is located at 20-26 Addison St Shellharbour
- All stalls must present to a quality standard of products and stall layout
- Market time is 9.00am to 3.30pm with stallholder set up times 7.30 to 8.45 (No exception given)
- Due to limited on-site power the Shellharbour Village Artisan Fair encourages early application for powered sites and notes that the use of un-silenced generators is prohibited
- Preference will be given to handmade, locally produced or local Artisans
STALL ALLOCATION:
- Stall allocations are available on the Wednesday before the Fair and all stall allocations are final
- Stall holders must not swap stall locations or set up outside the allocated stall area. Areas between stalls are for public access and are to be kept clear at all times
- Any structure erected by the stallholder must present within the allocated position and be fixed, where possible, in a secure manner. It is the responsibility of the stall holder that any umbrella, gazebo, tent, awning or any other erected structure does not present a safety risk under all circumstances
- Each stall holder agrees that any activity for, or against, or connected with the candidacy of any person(s) for office at federal, state and local government level of for office within the organisation is prohibited
- Stall location preference requests will be met where possible although final allocation will be at management discretion
- All stalls MUST be set-up before 8.45 am. If for any reason this time frame cannot be met, stallholders should contact the Artisan Fair co-ordinator on?????????? . It is at management discretion as to the entry of any late stall holder
- Applications are welcome for permanent site allocations and a reduced fee can be negotiated. This fee reduction may also apply to Artisans who book and pay several weeks in advance
- The Fair co-ordinator will be available from 7.30am on Artisan fair days to help with any questions stall holders may have regarding allocation or allocated positions
PRODUCTS:
- Management of Shellharbour Village Artisan Fair reserved the right to prohibit the sale and display of any item deemed to be offensive or not in keeping within Fair guidelines
- Above mentioned, preference will be given to handmade, locally produced or local Artisans and any changes in stall product range must have prior consent from management or fair co-ordinator to ensure the quality of items and best trading conditions are met for all fair participants
- Any goods bearing registered trademarks that are not deemed genuine products may be liable to damages and fines from The Anti-Counterfeiting Action Group (TACAG). TACAG monitor all fairs and markets and the accused stallholder with bare sole responsibility for any offence committed
- Only authorised food stallholders may sell hot/cold drinks (non-alcoholic) and food products
- Management of Shellharbour Village Artisan Fair is not permitted by law to grant monopoly rights to any stallholder
- All items for sale must be displayed upon a table or rack. No goods are to be placed on the ground unless the items are large pieces furniture
FOOD STALLS:
- All food stalls must comply within NSW Health Department guidelines and regulations
- All food stalls must be registered with the NSW food authority and be registered with NAFSIS (Food Standards Australia) and relevant council authority
- It is the stall holder’s responsibility to ensure that all electrical appliances and cables are regularly checked and tagged by a qualified electrician. Any appliance or cable that has not been tagged cannot be used within the village fair
- Only authorised stallholders will have access to power and note that the use of a generator (silenced) must have prior consent from management or the Fair co-ordinator
- All food stalls MUST have their own public liability insurance and documentation provided with any food stall application
- All PRODUCT rules apply for Food stall holders i.e. any changes in stall product range must have prior consent from management or fair co-ordinator, Only authorised food stallholders may sell hot/cold drinks (non-alcoholic) and food products etc
PARKING AND VEHICLE ACCESS
- Drop off zone for unloading vehicles is along Addison St and is limited to 15 mins per vehicle between the times of 7.30am and 8.30am. No stallholder parking will be permitted for longer than the allocated time of 15 mins
- All vehicles must be moved from the drop off zone prior to stall set-up
- Stall holders entering the fair from any entry point other than the designated drop off zone must notify management or the Fair co-ordinator
- Stall holder parking is available at the rear of the Stella Maritz complex or in the public car park behind Tangs Chinese and seafood restaurant
- Stall holders parking in surrounding streets and not in the designated car parks, must comply within parking and traffic regulations to avoid being fined
- Upon market completion stall holders are required to have all stall items packed prior to bringing vehicles to the drop off zone to be loaded
INSURANCE:
- Public Liability Insurance is compulsory for all stall holders with the minimum liability amount of $10000000 ensuring cover for any injury to the public or damage to property due to stall holder negligence
- All current Public Liability Insurance policies must show the following, insurer, limit of liability an expiration date
- Shellharbour Village Artisan Fair offers Public Liability Insurance to stall holders without personal policies at $? /site and market day. Please advise if you require cover on application. This fee includes administration and marketing surcharge
- ALL Food and Massage stallholders however must provide their own insurance policy
WEATHER:
- Shellharbour Village Artisan Fair is an all weather Fair and will operate in all weather conditions
- It is the stallholder’s responsibility to provide his or her own protection from all weather conditions
WASTE AND RUBBISH REMOVAL:
- It is the stallholder’s responsibility to remove ALL their own rubbish, boxes and any unwanted goods from their allocated site
- Rubbish bins on site are for public use only
- Shellharbour Village Fair monitors the use of all rubbish bins and any stallholders not adhering to the Terms and Conditions will forfeit site allocation and all advance monies paid
LOCATION:
Shellharbour Village Artisan Fair is located at 20-26 Addison St, Shellharbour within the beautiful Stella Maritz complex. A site map is available from the office
OFFICE AND AUTHORISED PERSONS:
- All authorised Shellharbour Village Artisan Fair persons will be clearly identified through Shellharbour Village Fair shirt and name tag
- The Shellharbour Village Artisan Fair office is located at ? and is open Tuesday to Thursday 10am-5pm
- On Fair days the office will be represented by the Fair co-ordinator. The Fair co-ordinator is authorised to take any action required regarding stalls, stallholders and the public on behalf of the office and management to ensure the safe and smooth running of the Fair environment
- Please be polite and courteous to all authorised persons as without them, our Fair would not be possible
PRICES (INC GST):
The Fountain - $40
The Cafe - $38
Upper Court - $35
Showcase Shop 1 - Between 27 and 30m2 - $120 (please note it is suitable for 3 Artisan stalls and if not booked wholly will be available at $45 per Artisan stall.)
Showcase Shop 2 - Between 40 and 50m2 - $150 (please note it is suitable for 4 Artisan stalls and if not booked wholly will be available at $45 per Artisan stall.)
Please note: Showcase shops are indoors and provide all weather protection and offer storage facilities ( A bond for use of keys and to ensure that Showcase shops are kept clean and without damage may be required)
TRESTLE TABLE/GAZEBO HIRE:
- Trestle tables and Gazebo’s are available for hire from $?. This includes a bond amount of $5 which will be returned to stallholders between 2.30pm and 3.30pm on Fair days
- Due to limited trestle tables and gazebos available, it is advised to book and pay in advance to ensure hire
- If a pre-booked and paid trestle table or gazebo is no longer required all payments are forfeited
- NO tables/gazebos will be available for hire on the day of the Fair
BOOKINGS AND PAYMENTS:
- It is the responsibility of all Artisans to read through and agree to all terms and conditions outlined in this document prior to applying for a position at the Stella Maritz Pty Ltd, Shellharbour Artisan Fair. All applications received will be deemed to be in acceptance with ALL Terms and Conditions.
- All applications are to be submitted either via post to ?, via e-mail?, via our online application form ? or via fax?. Once an application is approved full payment is required before a site will be allocated. Once payment has been processed a tax invoice receipt will be sent for your records
- Once site has been allocated payments cannot be refunded or transferred
- Payment methods accepted are cash- In person at the office during 10am and 5pm Tuesday to Thursday or Cheque-to be received via post on or before Wednesday prior to the Fair
- Applications may take up to 2 weeks to be processed although stallholders are welcome to phone the office on ? at any time, to check the progress of their application
- Shellharbour Village Artisan Fair and Stella Maritz Pty Ltd will not be held responsible for any changes in personal circumstances or poor weather conditions
- The right to operate a stall at the Shellharbour Village Artisan Fair does not create any form of tenancy or imply any granting of that future right
The Management of Shellharbour Village Artisan Fair reserves the right to vary the Terms and Conditions at any time
